Federal District Court Rejects State Plan for Two-Tiered Rate System, Blocks Rates Cut For ALL Youth in Group Homes.
Judge Marilyn Hall Patel issued an injunction late Friday enjoining the California Department of Social Services (CDSS) from implementing a 10% cut in rates for the care of both federally eligible and non-federally eligible foster youth placed in group homes.
In so doing, the federal district court judge rejected the state’s plan that would have implemented her initial injunction in California Alliance v Wagner and Rose (Alliance II) by setting up a two-tiered rate system with higher rates for federally eligible children and lower rates for children not federally eligible.
